§ 16-10. Prohibited uses within road right-of-way; permits; temporary road closings.

  • (a)

    The following are prohibited uses within any road right-of-way in the city:

    (1)

    Free distribution or sale or display or solicitation for free distribution or sale of any merchandise, goods, property or services;

    (2)

    Solicitation for charitable purposes;

    (3)

    Servicing or repairing of any vehicle, except the rendering of emergency service;

    (4)

    Storage of vehicles being serviced or repaired on abutting property or elsewhere; and

    (5)

    Display of advertising of any sort, except that a portion of the roadway may be used for an art festival, parade, fair, or other special event if permitted by the city.

    (b)

    The city may issue permits of limited duration for the temporary use of right-of-way of any city, county, or state road within the city for any of the uses prohibited by this section if it is determined that the use will not interfere with the safe and efficient movement of traffic and the use will cause no danger to the public.

    (c)

    Before any road in the city may be closed temporarily for a special event, the city must determine that the temporary closure of the road is necessary. If the road is a state road, the city must obtain prior written approval for the temporary road closure from the department of transportation.
