§ 19-372. Extension of water and sewer systems not mandated.

  • (a)

    Nothing in this division is intended to, nor may it be construed to, mandate the extension of any city water or sewer system. The decision to extend the systems rests in the sound discretion of the city commission.

    (b)

    City water, sewer or reclaimed water systems shall not be extended beyond the city limits unless approved by the city commission based on a finding that:

    (1)

    It is in the best interest of the city to extend the system in order to improve efficiency, quality of service, quality of environment, or, for some reason, the extension will benefit the city;

    (2)

    The property of the applicant cannot be annexed into the city at the time of such request; or

    (3)

    Provision is made for persons connecting to the extended system to annex into the city at the time the property is eligible for annexation unless the city commission determines that it is not in the best interest of the city to require such annexation.
