§ 19-216. Penalties.

  • (a)

    Article violations. Any person who is found to have violated any provision of this article or any condition of IWDP's issued hereunder, shall be, upon conviction, subject to penalty in an amount not to exceed the maximum amount permissible by law or at least $1,000.00 or by imprisonment for not more than six months, or by both, for each offense. Each separate violation shall constitute a separate offense, and upon conviction of a specified ordinance violation, each day of violation shall constitute a separate violation. In addition to the penalties provided herein, the city may recover reasonable attorney's fees, court costs, court reporter's fees and other expenses of litigation by appropriate suit at law against the person found to have violated this division or the orders, rules, regulations, and IWDPs issued hereunder.

    (b)

    Falsifying information. Any person who knowingly makes any false statements, representations or certification in any application, record, report, clan or other document filed or required to be maintained pursuant to this article, or IWDP, or who falsifies, tampers with, or knowingly renders inaccurate any monitoring device or method required under this article, shall, upon conviction, be subject to a penalty of at least $1,000.00 or by imprisonment for not more than six months, or by both. Each day on which a violation shall occur or continue shall be deemed a separate and distinct offense.
